Representative Matters
Representative disputes include:
Dispute between a design-builder and its subcontractor-designer arising from the construction of an interchange connecting two highways and related facilities in a congested area. The design-builder claimed the designer was negligent in preparing the design drawings that the design-builder used to estimate the cost of the project and prepare its bid. This resulted in construction scope growth, quantity increases, schedule impacts and cost increases. The design-builder sought to recover the cost increases from the designer. The designer counterclaimed and sought recovery of its unpaid invoices.
Dispute between an owner and contractor regarding the design, engineering, and procurement of a processing facility that extracted helium from natural gas. The dispute included claims for unpaid invoices, change to the work, negligence, gross negligence, failure to meet contract design specifications and performance guarantees, liquidated damages and whether the owner met the facilities designed feed gas requirements.
Dispute between design-builder and its mechanical subcontractor arising from the renovation of a department store into a pharmaceutical building, including laboratories, testing and research facilities. The dispute involved change order request by the subcontractor based upon entitlement, price and overtime, claims for acceleration, disruption and loss of productivity, claims for additional and extended supervision, claims for additional tools and equipment and claims for additional overhead and profit. The design-builder counterclaimed regarding defective and incomplete work by the subcontractor.
Dispute between a design-builder and its mechanical subcontractor regarding the installation of an exhaust steam duct and air-cooled condenser system for a combined cycle power plant. The subcontractor claimed it was entitled to additional compensation because the design-builder failed to deliver components reasonably inferable from the contract drawings and specifications, that the components were delivered inconsistent with the timing and sequencing in the subcontract and that site access was restricted requiring additional remote lay down areas. The design-builder sought liquidated damages for delay caused by the subcontractor and damages for defective and incomplete work by the subcontractor.
Dispute between a construction manager and an owner arising from a guaranteed maximum price contract for the construction of a 12-story apartment building. The construction manager sought damages for constructive termination for convenience and owner’s interference and recovery of unpaid invoices. Owner counterclaimed alleging defective work, overcharges, unexcused delays and liquidated damages.
Dispute between car rental companies and the lessor of a major international airport car rental facility regarding the allocation of facilities and space to each car rental company for their operations.
Dispute between a construction manager and an electrical subcontractor regarding the subcontractor’s claims for inefficiency, wage escalation and extended field supervision at a 24 story mixed use building designed for residential, hotel and commercial use.
